Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the mobile application Hotfork (the “App”), published by ZORDON INTELLIGENCE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (“we”, “us”). By downloading or using the App you accept these Terms.

1. The service

Hotfork is a free iOS application that reads public information — trending and searchable GitHub repositories — from GitHub’s public API and presents it on your device. The App is provided “as is” and “as available”.

2. No account, no fees

Using the App does not require an account. The App is provided free of charge; there are no subscriptions and no in-app purchases.

3. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to download and use the App for your own personal or professional use on Apple-branded devices you own or control, subject to these Terms, Apple’s App Store Terms of Service, and the Apple Standard EULA incorporated by reference (see EULA). You may not copy, modify, decompile, reverse-engineer, or redistribute the App except as permitted by mandatory law.

4. Acceptable use

You agree not to: use the App to violate any law or regulation; attempt to disrupt, overload, or gain unauthorized access to any service; or use the App to store or transmit unlawful or infringing material. You remain responsible for your own conduct while using the App and for any content you choose to bookmark or store locally.

5. Third-party data

The App displays data provided by GitHub’s public API. That data belongs to its respective owners and is subject to GitHub’s terms and license terms of each repository. We are not responsible for the accuracy, completeness, or legality of third-party data displayed through the App.

6. No warranties

To the maximum extent permitted by applicable law, the App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any third-party data will be continuously available.

7. Limitation of liability

To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of or inability to use the App, even if advised of the possibility of such damages. Where liability cannot be excluded by law, our aggregate liability shall not exceed the amount you paid for the App (zero — the App is free).

8. Termination

You may stop using the App at any time by deleting it. We may suspend or terminate access to the App without notice if you materially breach these Terms.

9. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Poland. Any disputes shall be subject to the exclusive jurisdiction of the Polish courts competent for the company’s registered office, without prejudice to mandatory consumer-protection rules that apply to consumers habitually resident in the European Union.
